
Mr. Caldwell is a seasoned trial attorney, with an emphasis on environmental, pharmaceutical, contract dispute, and class action litigation. He has also conducted special counsel investigations of alleged corporate misconduct in such areas as regulatory malfeasance, election law violations, fraud, conflicts of interest and embezzlement. In addition, as corporate counsel for the City of Atlantic City, he advised City leaders in such areas as labor and union disputes, regulatory affairs, tax matters, and complex transactions between the governing body and various casino interests while supervising outside counsel in a variety of litigated matters from alleged civil rights violations to zoning and city planning matters.
While working for the City of Atlantic City, Mr. Caldwell advised top officials on the environmental and regulatory aspects of land swaps and acquisitions leading to highway tunnel and multi-billion dollar casino development in the City's Marina District. He was the first in-house counsel to insist that he try his own cases. Mr. Caldwell's trial work consistently resulted in verdicts favorable to the City's positions and yielded substantial savings to taxpayers. His primary focus was on engineering and safety issues for an aging building stock with concomitant on-the-spot advising of City officials on the permissibility of police-power safety-based demolition of dangerous structures.
Mr. Caldwell has litigated complex business matters, including insurance fraud class actions, government investigations, consumer class actions, and contract disputes. He has represented insurers/reinsurers and insureds/reinsureds in relation to a wide range of disputes, including regulatory and coverage matters. Although Mr. Caldwell is a particularly skillful litigator, he also encourages and assists clients in the development of negotiated remedies, mediation and other dispute resolution techniques so that commercially effective results are achieved without the need for litigation.
